Yes, my old hornbook on Contracts has an entire chapter entitled "Third Party Beneficiaries". Perhaps you should read it, as it might help you go to sleep. If that is not enough, we can read about fraud as a tort and a crime..


Good. Then tell me, specifically, how a bidder on ebay is protected as a third-party beneficiary. Which of the exceptions to the doctrine of privity apply to ebay bidders, and please provide the specific facts that will qualify an ebay bidder for protection as a third-party beneficiary to a contract formed between ebay and the seller.


A good lawyer reads the entire document before he issues his opinion. And yes--I expect you only to read text, not minds.


....and a competent lawyer is clear and specific when drafting, leaving nothing to speculation or supposition.

If you will provide me with the EBay contract(s) that were in place at the time of the events described in posts #6 & #9, and then pay me my hourly rate to review the documents and research the law in the controlling jurisdiction (assuming that there is only one) with regard to both contract and tort issues, I'll be happy to do so.
