Can a store do this?

Today, on these forums I saw a thread regarding a sale going on at Perry Aircraft. The plane I was mostly interested in was the B-25 Mitchell RAF Sq. 226. On their website it is being listed on sale at $49.95. Well, I live in the same city so I thought, why pay shipping, I'll just drive down there myself and get it. I got there and asked the person (may have been the owner, I'm guessing his first or last name is Perry) regarding the model and tell them that on their site it says that it's on sale. He gives me a confused look and tells me that there's no such sale. Then he tells me that it must of been his son that made a mistake. But that's a pretty big mistake, because there are quite a few other planes on sale besides the one I'm interested in. He tells me can't sell the plane for $49.95 because of his own costs. So I left the store.

What I'm trying to figure out if this is really a mistake or if it's false advertising or what? I appreciate any advice you can give me. I was rather disapointed.

It is listed on Perry as you say for $49.95.
Go back and get in his face. It is advertised.... they should honour their pricing.
Print the screen if you have to.
All his B-25's are "reduced".

Tell him your next stop is the better business bureau.

I thought a business had to sell at the advertised price unless there was a posted written retraction of the sale item.

Not sure, but here's what I'd do.

Ring then up and buy it over the phone. I've bought from them a couple of times over the phone and given the special price. The asked me what the price was and do seem a bit cluless as to what price is currenlty on the web site. Then say your going to come and pick it up at the store - See if that works.

Don't bother wasting your time with the Better Business Bureau, they are basically useless. You call them, they will make a report and file it. They may actually call Perry's about the incident, but that is it. They have no real power to change things.

Should Perry's sell you the bird at the price listed? Yes. Are they obligated to sell it to you? No. Small business can make whatever decisions they want, it's up to the consumer with the cash on whether they like the deal or not?

You could always sue them for false advertising, since it really is posted on their web, but that is just silly. It's going to cost you how much in time and court cost to get how much off on the bird?

Just move on and don't bother giving them business is the most effective move you can make. No, you don't get the bird, but since you are not getting the deal anyway, what is the loss?

I just talked to Bob and ordered from his site this morning and bought the G for George 1:72 Lancaster for the sale price of 179.95
he honored the sale no problem.....It also could be that the sale is for on-line orders only....I bet if you went home
on-line and ordered it you would get it for the sale price...That sale price is still better then paying full price for it
even if you had to pay a few dollars for shipping.

Thanks guys for your help. Perhaps I'll try ordering it online. And I apologize for starting a second thread about this same problem. I just thought the my original had disapeared because I couldn't not find it at all but it has just re-appeared again.

Just watch the shipping charges if you buy from them. I had a lancaster shipped to Canada last year. They wquoted the shipping as surface mail, but when they got to the post office decided to send Express over night, then they proceeded to bill my credit card for the extra $50. To top it off, the declared the value at $100 more, so I got an extra $15 tax bill as well. When I complained they said sorry, nothing we can do, and that they would give me a discount next time. Fat chance I would buy from them again.
As an aside, this was over a year ago, so the details are a bit rough in mind, but I remember I had to pay an extra $70.

I'd print the screen and go back to them. If you still get attititude. Tell them you will explain it as you see it, on every diecast forum you can find. Word of mouth trumps the BBB. Then I'd say so long, and order from another. The time you'd save them by picking it up yourself should be worth the discount. This thread alone will do more damage than had you come back and said they were very cool about the service.
But his pre-sale Memphis Belle is listed at $299. Yeah, good luck with that.
