Re: Can a store do this?

Bought a couple of Corgi 1/72 Lancs online from Perry's last month, air shipping cost to Australia was on par with The Mule for this size diecast so my experience will Perry's is a good one

Re: Can a store do this?

Again, thank you all for your replies and advice! I really appreciate it!

I'm not too worried about the shipping charges as I live in the same city as the store. I just ordered the model, so we'll see what happens. I do have a confirmation email from them stating what my charges will be. Plus I do have the luxury of actually showing up on their doorstep and complain about overchaging face to face (although I hate having confrontations with people) if it happens. The owner did strike me a bit odd as he seemed out of touch with what was going on their own website, as some other members here have stated. I also agree with many of you regarding their prices. While some of them are reasonable, there are many that are completely outrageous, at least in my opinion.

I will make sure to report back on if and how my deal goes through. I've been collecting models (mostly tanks up to this point) for about 2 years now and this is the first dissapointing situation that I have experienced with a hobby store.

Thanks for the heads up on who to deal with. Next time it will be "the cat did it".

Re: Can a store do this?

Here's an update on my dealings with Perry Aircraft:

As I've said before, I was trying to purchase a Corgi AA35304 North American B-25J Mitchell II No. 226 Squadron, RAF Swanton Morley, Norfolk, June 1944 for $49.95 as stated on their website. I wasn't able to purchase it in person, however, I did place the order online and today I received the plane for $49.95 plus shipping (just as the website stated). If I was to by the plane in person it would have been $64.95. I am happy that I got the plane for a sale price, however, it's a bit strange that I couldn't buy it like that in person and on the website it does not state that the reduced price is applicable only to online orders. My advice to anyone who is looking to purchase anything from this store is to do it through the website only. Even if you have to pay shipping. In the end you'll still be saving money and perhaps even a headache of going to the store in person and trying to convince them that the plane you want is really on sale according to their website.

The reason he won't sell it to you in person is because he wants you to order it online or over the phone. Then he can HONK you on the shipping charges.

Re: Can a store do this?

Just as an FYI, generally speaking an advertisement to sell will be considered an offer and a buyer's expression of willingness to buy will be considered acceptance. Therefore, unless the offer contains an obvious mistake (i.e., a new Ferrari for $100 when the ad was intended to be $100,000) an enforceable contract is formed. Unfortunately, the only option to enforce the contract is to sue and obviously the dollar amount seldom justifies the expense of litigation. The subject matter of the contract may also affect its enforceability.

I have had more than one experience of proposing the avoidance of shipping charges by picking up an item in person only to have the seller refuse and say the deal is only good over the internet.

Generally this is likely true, but this particular vendor I've found charges very reasonable shipping rates.

The method used to communicate the "offer" is also a factor to be considered; the broader the circulation, the less likely it will be considered an offer in the context of an enforceable contract. However, if there is a limit on the number of acceptances (i.e., the first three purchasers can receive....), it will be considered an offer.

Plenty of retailers have "internet only" specials....nothing too unusual in that.

I don't know Pappy... $25.00 for one Corgi 1:32 model from Oregon to Utah seems like a lot to me. This is what I was charged (well... actually $20.00 after I begged for a shipping break, but I was told this would be the last time it would be $20.00 and that I was really crimping their profit on this one). It took two weeks for the model to arrive... no priority mailing on this one. Ironically, the model had missing parts so I had to ship it back to them. I FedEx'd it for $9.50!

I am not complaining because they took care of me and replaced the defective model, but with shipping rates like this, I will only use the vendor if I have no other options.
