How long has it been since they reported shipping it?

I sent an IXO P-38 to Australia last year via Airmail, at least that is what I paid for, but somehow it went the surface route and showed up about 3 months later than expected. The buyer accused me of not shipping it Airmail to save a buck but I had the receipt to prove it. Sometimes things get stuck in customs, international shipping can be hit and miss when it comes to transit times. If its only been a few weeks it could still show up, especially if you genuinely believe that the items were sent. Your recourse is limited to how you paid, Paypal you have a chance if you file a dispute within the alloted period, otherwise forget it.

The Date they said they shipped them was Dec 8th

Silly question, but usually on Ebay sellers are pretty clear about how they ship. If you did not pay the much higher shipping cost of Registered and or you did not pay for insurance, you do not have much ground to stand on.

Unless they were not clear about the shipping options, of course buying and selling from the USA to other Countries is not foolproof. I have shipped to the UK many times, Air Post under 4 lbs is very resonable and gets there 99% of the time, but if it does not and there is not insurance taken out, then there is not much you can do. EMS from here to the UK has tracking and insurance built in, but cost usually more than 2.5 times as much as Air Post.

Now as far as PayPal goes, if you submit your complaint within 45 days you might get your money back from them and if the seller was honest and they did ship it , they will lose out 100% on the deal, but I bet you both end up with a bad comment on Ebay.

Insurance wasnt an option, These planes were coming from the U.K. to here in the USA.
This was the first time this has happened to me from now on I will request shipping Insurance.

This is what the FAQ for Air Mail services says at the UK's Royal Mail website

14. Can I claim compensation for missing or damaged items?

Yes. All Airmail is covered by up to £32 compensation if the letter is lost or damaged and it's our fault. You cannot claim for items of value, unless they are sent by Airsure or International Signed For. Consequential Loss - compensation for any financial consequences of any damage or loss to items of mail - is not available. If your item is valuable, you can buy extra compensation of up to £250 or £500, depending on the destination. This additional compensation is only available when you use Airsure or International Signed For.


So if your planes were sent Air Mail this is your recourse
