Gates was commissioned as 2nd Lieut in US Air Force and served as an Intelligence officer at Whiteman AFB in Missouri in 1967. This info is from DoD bio of the Secretary.
He best correct this situation ASAP or he's going to experience more hostile action than he ever did as a second rate Lieutenant in beautiful downtown Whiteman!
If this Marine doesn't receive the MoH then the Medal itself has been disgraced. Any way to poll previous recipients, I'm sure they may have a different opinion than the paper-pusher.

OK, this really has me ticked off. The more I read the more I am convinced this was an injustice. 3 other soldiers were awarded the MOH for the same conduct in Iraq.

The best thing we can do, I think, is pepper the U.S. Representatives from the San Diego area (there are 4 Congressional Districts and I don't know exactly where this Marine lived) and California's Senators with e-mails demanding they look into this and ask the President to intervene and overrule Gates. Just be respectful but forceful.
