Well Corgi have certainly damaged my wallet.

Same here. I ended up with enough tokens to get two models, but decided to send in tokens for just one because of the limited availability. Maybe they could return the tokens and I could just slip them back into the boxes...

I looked again at the insert literature card which described the offer (red tokens= WW1; blue tokens= WW2; green tokens= Post-War; yellow tokens= Modern), and the only caveats in fine print related to: 1) availability based on run size (not whether they would be produced); 2) the fact the deal is first come, first served; 3) that all models are subject to availability based on their limited edition run (not specified); and 4) that all liveries are to be "confirmed." Therefore, the way I read this is that an offer was made and buyers accepted, and that we may be at Corgi's mercy as to the actual production run and we cannot really moan about the finish choice (as lame as it may be).

Agreed about the finish. But since it appears no one outside the UK received anything (and not just the Halifax, but the other models offered in the promotion as well), doesn't that set some sort of legal precedence or point of contention? The promotion was through Corgi USA, for North American collectors (sorry, I don't mean to exclude our friends down-under, I just don't know who you went through), and nothing was delivered. For us to be at Corgi's mercy for the actual production run they would have had to actually produce and deliver something here. Does that make sense? I guess I am trying to say they delivered nothing here in North America (as far as I know) so how can run size, first come/first served, etc be a legal point that Corgi can use in its defense.

The model that was released in the UK indicated a 150 model run. I remember seeing something about it initially being a bit higher than a 150 model run, is my memory correct or am I in error.

The model that was released in the UK indicated a 150 model run. I remember seeing something about it initially being a bit higher than a 150 model run, is my memory correct or am I in error.

The initial offer was for 500 models.

No, I'm not suggesting these are legal defenses to the duty to deliver on this deal. I just think the actual number is somewhat at Corgi's discretion.

Actually, I don't think Corgi could claim, for example, that the production run is say 5 pieces. There would be some issue of proof about a reasonable run, and potentially an issue about whether a super small run is just a dodge to get out of substantial compliance.

I think they are on the hook, and there is evidence out there somewhere, I seem to recall, suggesting the run number (though maybe I am just recalling what UK customers saw about a 150 piece run). And some of us (including yours truly) received confirming letters or e-mails.

And then there was this posted by Sniper-UK in February:

"We are producing a highly exclusive run of 500 models for each section of Aviation Archive that can only be obtained by collecting 6 tokens from inside the packs.These models will be variants of the 2007 new tooling and will be issued on a first come first served basis."

I've no idea of the source of this information; the card I got in my models does not mention a production run. I would be interested to read what is in the Corgi catalogue from last year. I have a copy somewhere but no idea where at the moment. I guess I will have to dig it up when they take my deposition.

I guess what I am trying to say (and badly it seems) is that they ran a promotion that included North American collectors (I would guess it could also be considered worldwide as collectors from other areas of the globe participated as well). Even if they initially announced a 500 unit run, and then dropped to a 150 unit run, by what reasoning could Corgi use to justify they had satisfied the terms of the promotion when all evidence (albeit circumstantial) appears to prove that no one outside the UK got any of the models? Let alone those people who received confirmation they were to receive one on this side of the Atlantic?

I believe we are saying the same thing OC, but I am coming from a different angle (some would say a different planet).

2007 catalogue clearly states a "limited run of 500 models for each section" (of the 4 colours).
Nobody has received any of the the other 3 models yet.

Here's a quick and simple way to get Corgi to answer simple questions related to this issue.

Contact your local Attorney General's Office by phone.

Give them a verbal breif whats going on.

They will send you a Complaint Form, fill it out, send it back.

And the AGO will contact Corgi on their letter head with a demand to explain the complaint.

A simple, fast and effective way, your Government at work for you.

Even if Hornsby honors the deal, how do you suppose they get information on who sent in tokens and who didn't if, for instance, Corgi deleted this information from it's database. I understand that some people received emails and letters, but what of those who only received a verbal confirmation from their customer service people?

Call me a pessimist, but I don't think it's gonna happen. I hope I'm wrong if for nothing but the principle!
